General Terms and Conditions (GTC) for the SEENLIEBE holiday home

1. Arrival/Departure from 4:00 PM / by 10:00 AM at the latest.

Arrival and departure times also apply to individually agreed weekdays. Departure must be by 10:00 AM on the day of departure at the latest. Overstaying the departure time by more than 30 minutes will result in the charge for an additional overnight stay. Other arrival and departure times can be individually agreed upon with the landlord. If the tenant does not arrive by 10:00 PM on the day of arrival (without prior notification to the landlord by telephone), the contract is considered terminated after a 24-hour notice period. The landlord may then freely dispose of the property. A (pro rata) refund of the rent due to early departure is generally not possible. Overnight stays by non-tenants (visitors) are prohibited and may lead to immediate termination of the tenancy. Additional overnight stays can only be considered prior to arrival and after consultation with the landlord. The rental costs may increase.

2. Payment

The rental agreement becomes valid upon receipt of the full payment into the landlord's account or on their registered portals. Payment of 100% of the rental amount is due within three days (for bank transfers) and immediately (for credit card payments) upon receipt of the booking documents. If the payment deadlines are not met, the landlord may withdraw from the contract. Failure to pay will constitute withdrawal and entitle the landlord to re-let the property. The total amount stated in the rental agreement includes additional costs (water, energy, final cleaning, waste disposal, GEZ = 7% VAT).

3. Cancellation

You can cancel the contract at any time. Cancellation must be made in writing (letter or email). In the event of cancellation, you are obligated to compensate us for any damages incurred:

- From the day the tenant receives payment until the 121st day before the start of the rental period, a €25 processing fee.

- From the 120th day to the 61st day before the start of the rental period, 10% of the total price plus a €25 processing fee.

- From the 60th day to the 15th day before the start of the rental period, 50% of the total price plus a €25 processing fee.

- From the 14th day to the start of the rental period, 100% of the total price plus a €25 processing fee.

The date of receipt of your cancellation notice is decisive. Any amounts already paid will be offset. You may provide a replacement who will enter into your contract under the stated conditions. Written notification is sufficient. Along with the booking documents, the tenant receives a recommendation to take out travel cancellation insurance.

4. Tenant's Obligations

The tenant undertakes to treat the rented property (holiday home, inventory, and outdoor facilities) with care. If damage to the holiday home and/or its inventory occurs during the rental period, the tenant is obligated to notify the landlord immediately. Defects and damage discovered upon arrival must be reported to the landlord immediately (by 8 p.m. on the day of arrival); otherwise, the tenant is liable for these damages. A reasonable period of time must be allowed to remedy damage and defects. Claims for complaints that are not reported immediately on site are excluded. Complaints received by the landlord only at the end of the stay or after the tenant has vacated the holiday home are also excluded from compensation. In the event of any disruptions to performance, the tenant is obligated to do everything reasonable within the scope of their legal obligations to help remedy the disruption and minimize any damage caused. On the day of departure, the tenant must remove all personal belongings, dispose of household waste in the designated containers, and store clean and washed dishes in the kitchen cupboards. The property must be left free of any rubbish. Subletting of the property by the tenant or overnight stays by third parties in the holiday home and/or on the property without the landlord's knowledge are strictly prohibited (see also point 1).Violations will result in immediate termination of the rental agreement by the landlord, and the property must be vacated immediately. If the tenant has left personal belongings behind and does not report them, the items will be destroyed after a retention period of three months after departure. Charging electric vehicles using the holiday home's electrical system is strictly prohibited. The cross-sections of the cables are not designed for this purpose. Several electric charging stations are located within a 15 km radius. It is also prohibited to charge e-bikes with loose or permanently installed batteries/accumulators in the house. Charging points are available in the bicycle storage room.

5. Pets are not allowed in the SEENLIEBE holiday home.

6. Data Protection

The tenant agrees that, as part of the contract concluded with them, necessary personal data may be stored, modified, and/or deleted. All personal data will be treated with absolute confidentiality and will not be shared with third parties. The tenant has the right to object to the storage of their data at any time. Deletion will take place within a reasonable period of time, provided there are no legal requirements (e.g., from a tax perspective) to the contrary.

7. Liability

This advertisement was prepared to the best of our knowledge. We assume no liability for any impact on the rental property caused by force majeure, power and water outages common in the country, or severe weather. Likewise, we assume no liability for the occurrence of unforeseeable or unavoidable circumstances such as official orders, sudden construction work, or disruptions due to natural or local conditions. However, the landlord will be happy to assist in resolving any problems (as far as possible). The landlord assumes no liability for the use of the provided play and sports equipment. The tenant's arrival and departure are at their own risk and responsibility. The landlord is not liable for personal belongings in the event of theft or fire. The tenant waives any claims for damages. The tenant is fully liable for any deliberate destruction or damage.

8. Final Provisions

Photos and text on the website or in the flyer serve to provide a realistic description. 100% conformity to the rental property cannot be guaranteed. The landlord reserves the right to make changes to the furnishings (e.g., furniture) provided they are of equivalent quality. Should one or more provisions of these terms and conditions be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid one that most closely reflects the economic and legal intent of the contracting parties. German law applies. The place of jurisdiction and performance is the landlord's place of residence.
